ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT

In consideration of being permitted to enter the Rocky Mountain Elk Foundation's Elk Mountain Homestead property ("Property) and to participate in the Elk Country Horseback Trail Ride, September 7-9, 2007, hereinafter called "The Activity", I, for myself, my heirs, personal representatives or assigns agree to the following:

If I am the parent or guardian of a child entering the Property or participating in The Activity, this agreement extends to both the parent or guardian and child, and reference to "me" or "I" refers to both.   I understand that the Property is located in a rural area of Pennsylvania and the nearest hospital and emergency services are 15 miles away in St. Mary's, Pennsylvania.   Cell phone, radio, or other communication is not available in many areas of the Property or the Elk State Forest.   I understand there could be significant delay in contacting emergency services and receiving medical treatment while on the Property or participating in The Activity.   I realize The Activity carries with it certain inherent risks which could result in physical or emotional injury, including, but not limited to, paralysis, death, or property damage.    These risks cannot be eliminated regardless of the care taken to avoid injuries.   Such risks include, but are not limited to, exposure to the elements, weather conditions, Property conditions, trail conditions, encounters with wild animals (including bears), natural hazards such as floods and fires, equipment failure or malfunction (whether or not provided by RMEF), physical exertion, and the behavior and actions of horses.

I understand that The Activity involves the use of horses, which can be dangerous and unpredictable animals.   Their use, handling and tack preparation can result in a range of injuries from minor to catastrophic, including, but not limited to, paralysis, death, or property damage.   I am providing my own horse(s) and my own equipment, tack and accessories associated with horse ownership, use, handling and riding. I ASSUME SOLE RESPONSIBILITY FOR MY HORSE(S) and their use and handling, and I ASSUME SOLE RESPONSIBILITY FOR MY PERSONAL PROPERTY brought on to the Property.

Assumption of Risk:   I have read the previous paragraphs and I know, understand, and appreciate the risks identified and other risks that are inherent in and may result from The Activity.   My participation in The Activity is voluntary, and I knowingly ASSUME ALL RISKS .   I understand that the Rocky Mountain Elk Foundation, Inc., its directors, officers, employees, agents, volunteers, and contractors do not assume any responsibility for my safety, or the safety of my horse(s), during The Activity and that such responsibility is my own.

Waiver of Liability:   I, for myself, my heirs, personal representatives or assigns, do hereby RELEASE, WAIVE AND DISCHARGE the Rocky Mountain Elk Foundation, Inc., its directors, officers, employees, agents, members and volunteers (the "Releasees") FROM ANY AN ALL LIABILITY (INCLUDING LIABILITY FOR NEGLIGENCE) resulting in personal injuries, accidents or illnesses (including death) to persons or horses, and property damage, arising from participation in The Activity.

Indemnification:   I agree to INDEMNIFY AND HOLD HARMLESS the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney's fees, brought as a result of my participation in The Activity or as a result of the actions of my horse(s), and to reimburse the Releasees for any such expenses incurred.

Acknowledgment of Understanding:   I have read this assumption of risk, waiver of liability, and indemnity agreement, and I FULLY UNDERSTAND its terms.   I am aware of the risks associated with my participation in The Activity, and I understand that I am GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE .   I am signing this agreement freely and voluntarily, and intend my signature to be binding and a COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY to the greatest extent allowed by law.
